The following list is a group of guidelines and additional terms of service for the AtomicGeek Mail service:

AtomicGeek Mail General Guidelines

Here are some key guidelines that apply to AtomicGeek Mail, in addition to those set forth in AtomicGeek's Terms of Service:

  1. Do not use the service for the transmission of "junk mail," "spam," "chain letters," or unsolicited mass distribution of email.
  2. Do not use the service for illegal purposes or for the transmission of material that is unlawful.
  3. Do not use the service for the transmission of material that is harassing, abusive, threatening, harmful, vulgar, obscene, or invasive of another's privacy.
  4. AtomicGeek considers email transmitted via its service to be the private correspondence between the sender and the recipient. AtomicGeek will not monitor, edit, or disclose the contents of a user's private communications, except that User agrees AtomicGeek may do so: (a) as required by law; (b) to comply with legal process; (c) if necessary to enforce AtomicGeek's Terms of Service, and these Mail Guidelines; (d) to respond to claims that such contents violate the rights of third parties; (e) to protect the rights or property of AtomicGeek or others; and (f) to identify or resolve technical problems or respond to complaints about the Service.
User understands and agrees the technical processing and transmission of email communications is and may be required (a) to send and receive messages; (b) to conform to the technical requirements of connecting networks; (c) to conform to the limitations of the Service; or (d) to conform to other, similar technical requirements.

AtomicGeek Mail Personal Address Terms of Service

1. ACCEPTANCE OF TERMS:

AtomicGeek ("AtomicGeek") Mail Personal Address service (the "Service"), owned and operated by AtomicGeek, is provided to you under the AtomicGeek Terms of Service (the "TOS") http://www.atomicgeek.net/tos.html as well as these Additional Terms (together the "Agreement"). AtomicGeek may update and change the Agreement from time to time without notice to you. You can always find the most recent version of these Additional Terms at http://www.atomicgeek.net/guidelines.html and the most recent version of the TOS at the URL indicated above. Please read the TOS and these Additional Terms before using the Service. Your use of the Service constitutes your agreement to all terms and conditions in the Agreement. By your use of the Service, you agree that you have read the Agreement and understand all of their content and you accept all the terms and conditions in the Agreement.

2. DESCRIPTION OF THE SERVICE:

The Service provides the functionality which allows AtomicGeek users ("You") to send and recieve e-mail messages via the internet, by using a POP3 account or Web Mail.

Your use of the Service may be terminated at any time. You acknowledge that your use of the Service may be terminated at any time as provided in the provision titled "Termination" in the TOS.

AtomicGeek POP Access and Mail Forwarding Terms of Service 

1. ACCEPTANCE OF TERMS

Welcome to POP Access for AtomicGeek E-mail! Your use of this service is subject to these additional terms that supplement the AtomicGeek Terms of Service (http://www.atomicgeek.net/tos.html ) and the AtomicGeek Mail General Guidelines (http://www.atomicgeek.net/guidelines.html), both incorporated by reference.

AtomicGeek reserves the right to update and change, from time to time, these additional terms and all documents incorporated by reference. You can always find the most recent version of these additional terms at http://www.atomicgeek.net/guidelines.html and the most recent version of the AtomicGeek Terms of Service and the AtomicGeek Mail General Guidelines at the URLs indicated above.

2. CERTAIN REQUIREMENT FOR POP ACCESS

Please note, you should check with your ISP to ensure that POP Access will work for you. Some ISPs do not allow their users to send messages with other SMTP servers. If your ISP does not allow access to the AtomicGeek SMTP servers, you will not be able to use a POP3 client to send e-mail through the AtomicGeek servers.

Also please check to make sure your email client supports authenticated SMTP. If you use a program that does not support the authenticated SMTP protocol, you will not be able to send mail using the AtomicGeek SMTP servers. The most recent versions of popular clients (Outlook, Outlook Express, and Eudora) do support authenticated SMTP.

3. CONDUCT AND OBLIGATIONS

The AtomicGeek Terms of Service, which apply to your use of POP Access, provides that AtomicGeek may establish limits on the maximum number of email messages that may be sent from or received by your AtomicGeek Mail account and the maximum size of any email message that may be sent from or received by your account. These limitations also apply to your use of POP Access.

You acknowledge that AtomicGeek has the right to suspend or terminate your account and refuse current or future use of any AtomicGeek service with or without warning if AtomicGeek believes you have violated or attempted to violate the rights of others, or have acted inconsistently with the spirit or letter of the AtomicGeek Terms of Service, lack of payment, the AtomicGeek Mail General Guidelines, or these additional terms. Please note, you will not be entitled to receive any type of refund if AtomicGeek cancels your service for the reasons indicated above.

4. SERVICE PROVIDED "AS-IS"

The AtomicGeek Terms of Service, which apply to your use of POP Access, provides that AtomicGeek services, which includes POP Access, is provided on an "as-is" and "as available" basis. You will not be entitled to receive a refund for any problems, technical or otherwise, beyond AtomicGeek's reasonable control.

5. INVALIDITY OF SPECIFIC TERMS

If any provision of these additional terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect.

6. LOCATION OF LAWSUIT

The AtomicGeek Terms of Service, which apply to your use of POP Access, provides that both you and AtomicGeek agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Hudson County, New Jersey.
